Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Gemini Omni Info Hub website and related services (collectively, the "Service") operated by Gushan AI / 孤山 AI ("we", "us", or "our") through gushanai.com and affiliated domains, including ai-geminiomni.com.

By accessing the Service, creating an account, signing in, purchasing credits, or using the prompt generator, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Gemini Omni Info Hub is an informational and creative tooling platform focused on Google Gemini and multimodal AI workflows. The Service may include:

• Educational articles, blog content, and product information about Gemini Omni and related models.
• A prompt generator that helps you compose and adapt prompts for video, image, and multimodal creative workflows.
• Account features including Google sign-in and email verification.
• A credits system used to access certain AI-powered features.
• Links and integrations with third-party AI, analytics, advertising, and payment services.

We may add, change, or discontinue features at any time. We do not guarantee availability of any specific model, API, or third-party integration.

You may need an account to use certain features. You agree to provide accurate information and keep your credentials secure. You are responsible for activity under your account.

Authentication may use Google OAuth or email one-time codes processed through our backend at gushanai.com. Session tokens may be stored locally in your browser (for example, auth_token and user_info in localStorage). You must notify us promptly at gemini-omni-support@gushanai.com if you suspect unauthorized access.

We may suspend or terminate accounts that violate these Terms, pose security risks, or are used for fraud or abuse.

The prompt generator and related AI features produce automated suggestions based on your inputs and configured templates. AI output is experimental and may be inaccurate, incomplete, biased, or unsuitable for your intended use.

You are solely responsible for reviewing, editing, and deciding whether to use any generated content. Do not rely on AI output as professional, legal, medical, financial, or safety-critical advice.

• We do not guarantee that prompts or outputs will work with any particular Gemini, Veo, or third-party model version.
• Usage may consume credits according to the pricing shown at purchase time.
• You must comply with Google's applicable terms, policies, and usage restrictions when using Gemini-related services.

Certain features require prepaid credits. Credit packs, prices, and bonus amounts are displayed on the pricing page before checkout.

Payments are processed by third-party payment providers (including Stripe and Creem, or successors we designate). We do not store full payment card numbers on our servers. Billing disputes should first be raised with us at gemini-omni-support@gushanai.com.

• Credits are generally non-transferable and have no cash value except as stated at purchase.
• Unless required by applicable law or explicitly stated in writing, purchases are final and non-refundable once credits are delivered.
• We may adjust credit pricing, pack sizes, or consumption rates with reasonable notice on the Service.
• Unused credits may expire if your account is terminated for cause or after a prolonged period of inactivity, if disclosed in product terms at purchase.
• Promotional or bonus credits may carry additional restrictions and expiry dates.

You agree not to misuse the Service. Prohibited conduct includes, without limitation:

• Violating applicable laws or third-party rights, including intellectual property, privacy, and export controls.
• Generating, distributing, or facilitating illegal, harmful, harassing, deceptive, or sexually exploitative content, especially involving minors.
• Attempting to reverse engineer, scrape, overload, or circumvent rate limits, paywalls, credit systems, or security controls.
• Using automated means to create accounts, send verification codes, or abuse the prompt generator at scale without authorization.
• Impersonating others, misrepresenting affiliation with Google or Gushan AI, or submitting false payment information.
• Uploading malware or interfering with the Service's operation or other users' access.

We may investigate violations and cooperate with law enforcement where required.

Content Standards and Prohibited Categories. Because the Service includes content-generation features (including image generation, image-to-video, text-to-video, and video generation), you must not use the Service to generate, request, facilitate, distribute, or publish content in any of the following prohibited categories:

• Sexually Explicit / NSFW / Adult Content: You may not generate pornography, explicit sexual content, non-consensual nudity, or other adult or sexually suggestive material.
• Violence / Gore / Graphic Violence: You may not generate content depicting torture, extreme gore, graphic self-harm, suicide instructions, terrorism promotion, or instructions for creating dangerous weapons or explosives.
• Hate Speech / Harassment: You may not generate content that attacks, demeans, or incites hatred or harassment against individuals or groups based on race, ethnicity, religion, disability, age, nationality, sexual orientation, gender, or similar protected characteristics, including cyberbullying or defamation.
• Child Safety (CSAM): Zero tolerance. You may not generate any content that sexualizes, exploits, or endangers minors, including child sexual abuse material (CSAM) or content that harms children's physical or mental well-being.
• Deepfakes / Impersonation: You may not generate synthetic media of real persons without their clear, informed consent, including face swaps, voice clones, or impersonation of public figures or private individuals for fraud, deception, or reputational harm.
• Copyright / Trademark Infringement: You may not generate content that knowingly infringes copyrights, trademarks, or other intellectual property rights, including unauthorized use of protected works, counterfeit branding, or deliberate plagiarism.

User Reporting Channel. If you believe content or conduct on the Service violates these Terms, report it to us promptly.

Send reports to gemini-omni-support@gushanai.com with enough detail for us to investigate. Please include, where available:

• The relevant prompt(s), URL(s), or screenshot(s) showing the violating content or behavior.
• A clear description of the violation type (referencing the categories above).
• For copyright or trademark reports, proof of ownership or authorization and identification of the infringed work or mark.

After we receive a valid report, we aim to acknowledge and begin review within 24–48 hours and may block generation, remove or disable content, restrict features, suspend accounts, or take other appropriate action.

Platform Content Moderation and Enforcement.

We maintain a layered moderation program that may include:

• Pre-generation safeguards: automated filters on text, image, audio, and video inputs using safety classifiers and sensitive-term detection before content is generated or delivered.
• Post-generation review: automated output screening, sampling-based human review, and investigation of user reports.
• Traceability: support for SynthID, C2PA, and similar provenance or watermarking standards where applicable through integrated models and providers.
• Account-level enforcement: warnings, credit deductions, feature restrictions, temporary suspensions, permanent bans, and forfeiture of remaining credits without refund where permitted by law and our policies.

Depending on severity and repeat violations, enforcement actions may include real-time blocking of prohibited generation requests, removal of violating outputs, account suspension or termination, and clearing remaining credits or tokens without refund. For CSAM, credible threats of violence, or other serious criminal conduct, we may preserve evidence and report to law enforcement as required by applicable law.

The Service, including site design, branding, documentation, and original content (excluding user inputs and third-party materials), is owned by Gushan AI or its licensors and protected by intellectual property laws.

Google, Gemini, Gemini Omni, Veo, Google Flow, and related marks are trademarks of Google LLC. We are not Google, and reference to Google products is for descriptive purposes only.

Subject to these Terms and applicable law, you retain rights in content you submit. You grant us a limited license to host, process, and display your inputs and outputs as needed to operate the Service, provide support, prevent abuse, and improve features in aggregated or de-identified form where permitted.

The Service relies on third parties, including Google (OAuth, AI, and analytics), payment processors, hosting providers, and advertising partners (such as Google AdSense). Your use of those services is subject to their separate terms and privacy policies.

We are not responsible for third-party services, outages, pricing changes, or content they provide.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF AI OUTPUT.

We do not warrant uninterrupted or error-free operation, that defects will be corrected, or that the Service or servers are free of harmful components.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GUSHAN AI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us for credits in the twelve months before the claim, or (b) USD $50.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

You agree to defend, indemnify, and hold harmless Gushan AI and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms or applicable law.

We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Continued use after changes take effect constitutes acceptance. If you disagree, stop using the Service and contact us to close your account.

These Terms are governed by the laws applicable to Gushan AI's place of operation, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country of residence provide otherwise.

Before filing a formal claim, you agree to contact us at gemini-omni-support@gushanai.com and attempt to resolve the dispute informally within 30 days. Where permitted, disputes will be resolved in the competent courts of our principal place of business unless mandatory law requires a different forum.
